1. Acceptance of Terms

By downloading, accessing, or using the Velor mobile application ("App") or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Velor ("Company," "we," "us," or "our").

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. We reserve the right to refuse access to anyone at any time.

3. Description of Service

Velor is a seamless, on-demand platform that connects users with premium boat rental experiences. The Service allows users to discover, browse, and book boat rentals from third-party owners and operators ("Hosts"). Velor acts solely as an intermediary marketplace and is not responsible for the condition, safety, or legality of the boats listed.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

5. Bookings and Payments

When you make a booking through Velor:

• You enter into a direct agreement with the Host for the rental of the boat.
• All prices are displayed in the applicable currency and may include taxes and service fees.
• Payment is processed securely through our third-party payment processors.
• You authorize us to charge your chosen payment method for the full booking amount at the time of confirmation.
• Velor reserves the right to cancel bookings in cases of fraud, misuse, or violation of these Terms.

6. Cancellation and Refund Policy

Cancellation terms vary by Host. The following general policy applies unless otherwise stated:

• More than 72 hours before booking: Full refund minus service fees.
• 24–72 hours before booking: 50% refund of the rental amount.
• Less than 24 hours: No refund.
• Force majeure events (severe weather, natural disasters) may be eligible for full refunds at Velor's sole discretion.
• Refunds are processed within 5–10 business days to the original payment method.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations.
• Impersonate any person or entity or misrepresent your affiliation.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Collect or harvest user data without consent.
• Post false, misleading, or fraudulent reviews or content.

8. Safety and Compliance

All users are solely responsible for complying with applicable maritime laws, safety regulations, and local rules governing the use of boats in their jurisdiction. You must hold any required licenses or certifications to operate a vessel. Velor is not liable for any injury, loss, or damage arising from your use of a rented boat.

9. Intellectual Property

All content, trademarks, logos, and intellectual property on the Service are owned by or licensed to Velor. You may not reproduce, distribute, modify, or create derivative works without our express written permission. You retain ownership of any content you submit but grant Velor a worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW:

• Velor disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
• Velor is not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability to you shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Velor and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which Velor is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. You waive the right to participate in class action lawsuits against Velor.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, notifying you via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

15. Apple-Specific Terms

If you access the Service through Apple's App Store, you acknowledge and agree that:

• These Terms are between you and Velor only, not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any product liability claims, consumer protection claims, or third-party intellectual property claims related to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the App purchase price, if any; all other warranty obligations are Velor's alone.
